A class action lawsuit has been filed against PETA by an individual in California who claims the organization violated the Telephone Consumer Protection Act by sending unsolicited text messages.
The text messages advertised the availability of Beyond Meat products at On the Border locations.
The plaintiff claims Beyond Meat authorized the unsolicited messages and that they knew they were in violation of the law.
“While defendant PETA, as a nonprofit organization, would typically not be subject to the [Federal Communications Commission’s] express written consent rule, it is in this case because it was acting as a conduit for defendant Beyond Meat, a for-profit corporation, and because it was engaged in marketing,” the suit argued.
The plaintiff claimed the messages caused her actual harm, “including invasion of her privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion. Defendants’ text messages also inconvenienced [the] plaintiff and caused disruption to her daily life.”
