On Sept. 6, R-CALF filed a reply in the ongoing case against the Montana Beef Council. Most recently, on Aug. 9, the group filed a supplemental pleading seeking to expand the case to 13 additional state beef councils.
The USDA, the defendant, responded with an objection to the expansion, claiming it would prejudice them and that expanding the case to other states would be an improper venue.
“Defendants have no right to have cases concerning their insufficient control of state beef councils venued in each beef council’s home state and they have cited no authority to support their contention,” R-CALF argued in its reply.
The reply also asks the court to expand the expansion to a total of 15 states with the addition of Maryland.
