Legal Ledger Brief: DOI reviewing taking of birds

The Department of the Interior (DOI) announced a proposed rule May 6 to revoke the January 2021 regulation that limited the scope of the Migratory Bird Treaty Act (MBTA).

The proposed rule gives notice that the U.S. Fish and Wildlife Service plans to revoke the January rule’s interpretation of the MBTA, and return to “implementing the MBTA as prohibiting incidental take and applying enforcement discretion, consistent with judicial precedent.”

The rule made earlier this year made changes to MBTA to exclude incidental take of migratory birds.

DOI is soliciting public comments on “issues of fact, law and policy raised by the MBTA rule published on Jan. 7.”
