Upside Foods, a California-based company producing cultivated chicken, was back in court to challenge Florida’s ban on lab-grown products.
The company asked the 11th Circuit Court of Appeals on Nov. 4 to allow its challenge to proceed after a lower court ruled against its case. District Judge Mark Walker initially allowed the case to move forward, but later dismissed most of its claims last fall, saying that any potential Poultry Products Inspection Act violations would have to be brought by the federal government.
On Nov. 4, the three-judge appellate panel seemed to agree with the lower court, with District Judge Paul Huck reportedly saying, “You don’t have the right to bring this because the government has the exclusive right to bring cases with regard to the violations of the [Poultry Products Inspection Act] or to enforce the act.”
