Dec. 13 is the last day to submit comments on a proposed date change to the 2015 Waters of the U.S. (WOTUS) rule. The proposed change would add an “applicability date” to the text of the 2015 WOTUS rule. Currently, the 2015 WOTUS rule has been stayed by court injunctions. During the stay and ongoing legal discussions over the rule, the EPA and the Army Corps of Engineers must use the pre-rule status quo related to Clean Water Act jurisdiction. This proposal would codify this action into the rule’s text. To submit comments online, go to www.regulations.gov and use the search phrase “EPA-HQ-OW-2017-0644.”
