Attorneys general from nearly two dozen states submitted their concerns with the Department of Labor’s proposed rule to improve protections for temporary workers in agriculture by allowing unionization.
In response to the proposed rule, the attorneys general wrote that the rule violates the major questions doctrine because Congress did not authorize the Department of Labor to grant migrant farmworkers the right to unionize through the rulemaking process.
“Once again, the Biden administration has placed the interests of foreign nationals over the interests of United States citizens,” Kansas Attorney General Kris Kobach said in a statement.
Attorneys general from the following states signed onto the letter: Alabama, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Mississippi, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah and Virginia.
