A federal judge gave Nebraska Beef another opportunity to avoid being found in contempt of court for failing to share documents related to a Big Four price-fixing case.
According to a report by the Omaha World-Herald, JBS attorneys have subpoenaed cattle price documents from Nebraska Beef in an attempt to prove the company hasn’t engaged in price fixing. A Nebraska Beef attorney said the company has supplied JBS with the information it sought.
In August, the court ordered Nebraska Beef to allow an expert to examine their computer system and pull data, which Nebraska appealed but was not successful. The company asked for multiple extensions and did not allow access before the final deadline. JBS asked for Nebraska Beef to be found in contempt.
U.S. Magistrate Judge Cheryl Zwart did not find Nebraska Beef in contempt of the court, but said the company had “one last and final opportunity” to comply. If not, then the company will be found in contempt.
