Legal Ledger Brief: WTO complaints continue over metal tariffs

There are still many complaints stemming from the steel and aluminum tariffs the U.S. issued in March.

On Monday, Aug. 27, China issued an additional dispute consultation with the World Trade Organization regarding tariffs from the U.S. on Chinese goods. This complaint is specifically regarding the $16 billion in tariffs the U.S. issued against select Chinese goods on Aug. 7. This was the second tranche of tariffs that, when combined with the first tranche, covers an estimated $50 billion worth of imports from China. China claims the tariffs only target Chinese goods and “exceed the United States’ bound duty rates.”

In a similar, if reversed situation, the U.S. initiated a dispute complaint to the WTO against Russia last week. According to the complaint, Russia has been applying duties on certain U.S. imports above what it applies on like products from other countries. The request for dispute consultations stated that the additional duties applied by Russia against U.S. goods “are inconsistent with provisions of the WTO’s General Agreement on Tariffs and Trade.”
