Legal Ledger Brief: Texas Senate passes eminent domain reform

On April 4, the Texas state Senate passed state Senate Bill 421.

The bill tries to curtail how, when, where, and by whom the state’s rather loose eminent domain laws can be used.

Generally speaking, the bill would require that a private entity allowed to utilize Texas’ eminent domain law must offer “just compensation … equal to or greater than the market value of the property rights” it is seeking, among other things.

“This bill levels the playing field between those who own property, and those who seek to use eminent domain to take that property.

It is vital to treat landowners with respect, dignity and fairness,” said the bill’s sponsor, Sen. Lois Kolkhorst, after the vote.

The Texas and Southwestern Cattle Raisers Association worked with her on the bill, which will now be considered by the Texas state House of Representatives.
