The Supreme Court of the United States (SCOTUS) rejected a Kansas appeal to revive a law that banned secret filming at processing and other livestock facilities.
The 10th Circuit Court of Appeals previously ruled that even if deception was used to enter private property, Kansas cannot discriminate on whether the person plans to harm or help the operation.
The decision followed a permanent injunction issued by a federal judge in 2020. The law made it illegal to take a photo or video at a facility without the owner’s consent or to enter the facility under false pretenses.
