A lawsuit filed by Public Employees for Environmental Responsibility and Western Watersheds Project insists Bureau of Land Management Acting Director William Perry Pendley must step down from his current position while going through the Senate confirmation process.
Pendley has been serving as the acting director for nearly a year now and was just nominated by President Donald Trump to the Senate for consideration as the full director.
The Federal Vacancies Reform Act reads “… a person may not serve as an acting officer for an office under this section, if—…..the President submits a nomination of such person to the Senate for appointment to such office.”
