Congress introduced dual-chamber legislation intended to protect small businesses from anticompetitive pricing practices that favor large retailers.
Under the Fair Competition for Small Business Act of 2025, state attorneys general would be authorized to bring civil actions for damages when retailers violate the Robinson-Patman Act. The act prohibits suppliers from charging competing buyers different prices. While state attorneys general can enforce the act, authority is limited to seeking injunctive relief. The bill was introduced in the Senate by Sen. Cory Booker (D-NJ) and in the House by Rep. Maxine Waters (D-CA-43).
“By strengthening the Robinson-Patman Act, state attorneys general would be able to hold these retailers accountable, ensuring that small businesses can compete, and succeed, on a level playing field,” Booker said.
