Thursday, Jan. 4, U.S. Circuit Judge Margaret McKeown ruled that Idaho’s 2014 “ag gag” law which banned the taking of photography and video on farms and livestock operations was unconstitutional. Specifically, McKeown ruled that the law violates the free speech clause of the First Amendment. However, the judge did maintain that the law correctly criminalizes people using fraud to obtain access to farms or livestock operations for the purposes of taking undercover pictures or video.
